Need some free legal advice regarding personal loan (Fort Worth)
I am in a situation and need some quick free legal advice, just as far as what I should do or not. This is regarding a personal loan and a promissory note, so a civil or bankruptcy attorney might be best, or perhaps willing to contact this other attorney and help me a bit.

Here is my story. Over the past several years I borrowed approximately $8K from a friend. This person used to work at my current place of employment, and was a supervisor, but we were also friends outside of the office. Yes, I realize this was a stupid situation and a dumb thing to do. A few months ago we had a falling out and he asked for the entire lump sum paid in full. I only make $2K/month total, have a mortgage and other bills, and have zero savings at all (I currently don't even have a bank account), and I explained to him that while I was willing to repay, there was no way I could do it in full all at once. He insisted I get a loan from a bank (I am unable to do this due to bad credit) and repay him in full. I explained my financial situation and offered a payment plan of $500/month. He then contacted an attorney, who has contacted me. I explained to the attorney that I wanted to pay the debt, but just could not do it all at once. He said he would talk to the client and get back to me. I received a certified letter offering a $2K down payment due Dec 1 and then $500/month until the remainder is paid. I did agree to the payment plan via phone, but have not signed & returned the promissory note yet. Quite honestly $2K is my entire monthly income and now I have no way to pay this by Dec 1. I can probably pay $1K and then another $1K middle of the month when I get my Christmas bonus.

Also about 3 weeks ago, I received an email from my "friend" (the client) telling me that he has been advised to bring embezzlement charges against me and that he was planning to call and inform my employers (specifically my 2 bosses) of my unwillingness to repay him. (Again this friend and I used to work together, he was technically my supervisor, but we were friends outside of the office. The loans did occur while he was employed here, but the office never really played a role.) He said this would more than likely result in me losing my job, and I had better act fast. It was very threatening. I replied to him and explained in a very business-like fashion that I was willing to repay the debt and not ignoring it, and that I wouldn't be able to repay anything if I didn't have a job.

I spoke with his attorney and he was very surprised. He also said he was not sure who he was receiving this advice from. I asked him if this could still happen and explained that I'm willing to repay in agreement with his terms, and he said he would talk to the client. Then I received an email that no criminal charges would be filed and the matter had been resolved so long as I stick to the payment plan.

So, here are my questions:

1. Can this person file criminal charges on me? Do embezzlement charges apply to a personal loan that hasn't been repaid? Can he call my job and tell them I don't want to repay? I don't want to lose my job over this. What is my legal recourse if he does this? Or can he even do this?

2. The payment plan. I cannot afford $2K this week. I can probably pay $1K and the remaining amount shortly thereafter, then do the $500/month. Should I call the attorney and explain this, or what? I'm just wondering if I don't agree to the payment plan, is this going to cause the client to file charges on me or something? I am willing to pay but I can only pay 1/2 of the suggested down payment.
